North Dakota voters reject recreational marijuana legalization in 2022

Ballot measure fails despite years of subsequent regulatory movement toward medical cannabis and decriminalization.

North Dakota rejected a recreational marijuana legalization ballot measure in November 2022, according to The Hill. The outcome appeared to close off a direct path to adult-use sales in the state at that time.

Since the defeat, however, North Dakota has moved incrementally toward cannabis policy reform on narrower fronts. The state legalized medical marijuana edibles in 2025 and passed a bill allowing fines rather than court proceedings for low-level marijuana offenses in March 2025. Tribal nations within the state—including MHA Nation and White Earth Nation—have pursued independent legalization and retail licensing, with White Earth opening a retail operation in early 2026.

The rejection suggests voter hesitation on full legalization, yet subsequent legislative activity and tribal-level licensing indicate the state remains in flux on cannabis policy. Watch for whether tribal retail expansion or any medical cannabis market growth creates new momentum for a future state-level legalization ballot measure.
